ARTICLE 1. IDENTIFICATION OF THE OWNER

These General Terms and Conditions govern the provision of the services offered by Energy Dance Studios, a brand integrated within DENERGYGROUP.

For the purposes of these terms, Energy Dance Studios is managed by Mario Saborido Bauló, Spanish self-employed professional with N.I.F.

47893851P and domiciled at C/ Antonio Machado 64, Esc. C, Ground floor 6, 08630 Abrera (Barcelona), or by the natural or legal person who holds ownership of the business at any given time, these General Terms remaining fully in force in the event of transfer, assignment or change of ownership.

For any query relating to the contracting or provision of services, clients may contact us through the official communication channels provided by Energy Dance Studios, especially by email at contacto@energydance.es and through the website www.energydance.es.

ARTICLE 2. SCOPE OF APPLICATION

These General Terms and Conditions govern the contracting and provision of all services, activities and products offered by Energy Dance Studios, including, among others, regular classes, intensive courses, workshops, competitions, shows, events, space rentals, product sales, merchandising and any other service marketed by the school.

Where a specific service has particular conditions, pre-contractual documentation or specific contracts, these will prevail only in those aspects where there is a contradiction with these General Terms.

ARTICLE 3. CONTRACTING PROCESS

Any service may be contracted in person or online through the channels provided by Energy Dance Studios.

To formalise the contract, the client must complete the documentation required, provide truthful and complete information, accept these General Terms and Conditions and, where applicable, the specific documentation for the contracted service.

Energy Dance Studios may request additional documentation or authorisations when necessary for the proper provision of the service.

The contract will not be considered concluded until Energy Dance Studios confirms acceptance of the request or allows effective access to the contracted service.

Energy Dance Studios reserves the right of admission and may reject any request where there are justified reasons.

ARTICLE 4. SERVICES OFFERED

Energy Dance Studios offers different services related to the training, practice and promotion of dance and other complementary activities. Each service may have particular conditions, pre-contractual documentation or specific rules that will supplement these General Terms.

ARTICLE 5. PRICES, NON-PAYMENT AND PAYMENT METHODS

The applicable prices will be those in force at the time of contracting or those expressly indicated for each service, promotion or campaign.

Energy Dance Studios may accept, depending on the service, product, centre or availability at any given time, any of the following payment methods: cash, bank transfer, bank card, card terminal, payment platforms such as Stripe for one-off or recurring payments, direct debits or other systems that may be enabled in the future.

When the client provides their bank details or enters their card on a payment platform authorised by Energy Dance Studios for the contracting of a service or the management of recurring payments, they expressly authorise the corresponding charges in accordance with the conditions accepted.

Unless expressly stated otherwise, the corresponding amount must be paid before the start of the contracted service. Energy Dance Studios may deny or suspend access to any service while amounts remain unpaid.

If more than 10 days pass after the payment deadline without the fee having been paid, Energy Dance Studios may temporarily suspend access to the service.

If more than 60 days pass after the due date without the client having settled their situation, Energy Dance Studios may terminate the contract and process the student's definitive withdrawal, without prejudice to the client remaining obliged to pay all outstanding amounts, as well as any costs that may apply.

If the client wishes to contract any Energy Dance Studios service again after being withdrawn for non-payment, they must complete a new registration and pay again the enrolment or joining fee in force at that time, unless Energy Dance Studios expressly determines otherwise. The contracting client or any beneficiary associated with them may not complete new registrations, access activities or contract services offered by Energy Dance Studios or by any other brand or project integrated within DENERGYGROUP while overdue and unpaid amounts remain with any of them. Full settlement of the debt will be an essential requirement to enjoy the services again, unless expressly authorised by DENERGYGROUP.

ARTICLE 6. DURATION, RENEWAL AND CANCELLATION

The duration of each service will be that established in its specific documentation or, failing that, that agreed between the parties.

Where applicable, the contract may be renewed automatically until the client requests cancellation in accordance with the procedure established by Energy Dance Studios.

ARTICLE 7. MODIFICATION OF THE SERVICE

Energy Dance Studios may modify at any time and whenever it considers necessary any aspect related to the provision of its services, including, among others, schedules, calendars, groups, levels, teachers, methodology, facilities, locations, activities, capacity, distribution of students, platforms used or any other organisational or technical matter, without this giving rise to any right to compensation, claim or indemnity.

These modifications may be made even without prior notice.

If, as a result of an organisational change, the client can no longer enjoy the contracted service, they may request termination of the contract. In duly justified cases and after assessment and express approval by the Management of Energy Dance Studios, any penalty or minimum-commitment period that may exist may be waived.

Changes that substantially affect fees, financial conditions or the general terms of contracting will be communicated with a minimum notice of 30 calendar days, so that the client can exercise their corresponding rights and decide whether to accept them and continue with the service, or terminate the contract.

The specific conditions applicable to each particular service will supplement the provisions of this article and prevail over it in case of contradiction.

ARTICLE 8. CANCELLATIONS, MAKE-UPS AND CLOSURES

Each service may have its own conditions regarding cancellations, make-ups or refunds.

Unless expressly stated otherwise, Energy Dance Studios is not obliged to provide financial compensation for classes, activities or services not enjoyed due to causes beyond the centre's control.

ARTICLE 9. ADDITIONAL SERVICES

Competitions, shows, workshops, intensives, trips, merchandising, space rentals and any other complementary service may have their own specific conditions, which will be communicated to the client in advance.

Merchandising purchases will not be refunded unless due to a manufacturing defect.

ARTICLE 10. RIGHT OF ADMISSION AND TERMINATION OF CONTRACT

Energy Dance Studios reserves the right of admission and may suspend or terminate the contractual relationship where there are breaches of these General Terms, non-payment, falsified documents, conduct contrary to the proper functioning of the centre or any other justified cause.

ARTICLE 11. LIABILITY

Each client, student or beneficiary is solely responsible for the safekeeping of their personal belongings. Energy Dance Studios is not responsible for the loss, theft, damage or disappearance of money, mobile phones, jewellery, clothing or other belongings brought onto its premises, and therefore expressly recommends not bringing valuables or unnecessary electronic devices during the activity.

Energy Dance Studios holds Civil Liability Insurance in accordance with applicable regulations for the conduct of its activity. However, this insurance does not replace and is not equivalent to personal accident insurance for students or beneficiaries.

By contracting any service, the client declares and guarantees, under their sole responsibility, that they or the designated beneficiary are in adequate physical, mental and health condition to take part in the contracted activity, and do not suffer from injuries, illnesses or limitations that are incompatible with its practice or put them at risk.

Participation in the sporting and artistic activities organised by Energy Dance Studios is voluntary and under the responsibility of the client or beneficiary, who assume the risks inherent in this type of activity, including falls, knocks, muscle or joint injuries or any other incident arising from normal practice, provided there is no wilful misconduct or gross negligence attributable to Energy Dance Studios.

Energy Dance Studios recommends that all students have their own accident insurance or equivalent covering the practice of sporting activities, as these are disciplines in which injuries or incidents can occur that are impossible to foresee or completely avoid.

In no case will Energy Dance Studios be liable for damages arising from false, incomplete or omitted information provided by the client during the contracting process, or for the consequences of taking part in an activity without being in adequate physical or health condition to do so.

ARTICLE 12. IMAGE RIGHTS AND INTELLECTUAL PROPERTY

The processing of students' image and voice will be governed by the specific authorisation signed for that purpose.

All content, brands, logos, designs, methodologies, choreographies and materials created by Energy Dance Studios are protected by current intellectual and industrial property legislation.

ARTICLE 13. DATA PROTECTION

Personal data will be processed in accordance with the current Privacy Policy of Energy Dance Studios and applicable data protection legislation.

ARTICLE 14. COMMUNICATIONS

Communications between the parties may be made by email, digital platforms, apps, phone, SMS, instant messaging or any other means provided by Energy Dance Studios.

However, official procedures, such as cancellation requests, complaints, contract changes, refunds, exercise of rights or any other administrative matter, must be made in writing through Energy Dance Studios' official email or through the specific procedure established for each case. Requests made by other means, including WhatsApp, phone calls or verbal communications, will have no effect.

Any communication regarding services, schedules, fees, promotions, conditions or any other contractual aspect will only be official when issued by the Management or by authorised administrative staff of Energy Dance Studios through its official channels.

Teachers and technical staff are not authorised to accept cancellations, grant refunds, modify contracts, make commitments or resolve administrative matters on behalf of Energy Dance Studios. Any information provided by them is for guidance only and is not binding until confirmed by the Management or the relevant department.

ARTICLE 15. MODIFICATION OF THE GENERAL TERMS

Energy Dance Studios may modify these General Terms and Conditions at any time.

ARTICLE 16. CHANGE OF OWNERSHIP

The transfer, assignment, sale or reorganisation of Energy Dance Studios, its brand or the owning entity will not affect the continuity of existing contracts, which will remain fully valid with the new owner.

ARTICLE 17. PARTIAL INVALIDITY AND APPLICABLE LAW

The nullity or invalidity of any of the clauses of these General Terms will not affect the validity of the rest of their content, which will remain fully in force. These General Terms will be governed by Spanish law. Any dispute will be resolved before the competent courts and tribunals in accordance with current legislation.

ARTICLE 18. RIGHT OF WITHDRAWAL

For contracts made at a distance or away from business premises, the client will have, where legally applicable, the right of withdrawal under the terms provided by current legislation.

To exercise this right, the client must notify it in writing through Energy Dance Studios' official email contacto@energydance.es before the end of the corresponding period (14 days), stating their identification details and the contracted service.

Where, due to the nature of the service or the application of current legislation, the right of withdrawal does not apply or is limited, the corresponding legal provisions and the particular conditions of the contracted service will prevail.
